Platone Mobile Terms and Conditions of Use
Terms and conditions of use for the Platone mobile application.
1. About these terms
These terms and conditions ("Terms") govern your access to and use of the Platone mobile application ("App"). By downloading, installing, accessing or using the App, you agree to be bound by these Terms.
The App is supplied by PLATONE LTD, a company registered in NORTHERN IRELAND under company number NI737282, with its registered office at PLATONE LTD, UNIT 19, Antrim Enterprise Agency, 58 Greystone Road, Antrim, Northern Ireland, BT41 1JZ ("we", "us", "our"). 2. Who may use the app
The App is a enterprise workforce application intended solely for business and professional use by authorised users. It is not available for personal, domestic or consumer use.
You may only use the App if your employer, or an organisation that has engaged you as a worker or contractor ("Organisation"), has entered into a valid commercial agreement with us or an authorised partner and has issued you with credentials to access the App.
3. Licence to use the app
Subject to your compliance with these Terms and your Organisation's agreement with us, we grant you a limited, non-exclusive, non-transferable, revocable licence to download, install and use the App on mobile devices owned, leased or controlled by you or your Organisation solely for performing your work duties.
4. Acceptable use
You agree to use the App lawfully and responsibly. You must not:
- copy, modify, adapt, translate or create derivative works based on the App;
- reverse engineer, decompile, disassemble or attempt to extract the source code of the App except as permitted by law;
- rent, lease, sub-licence, sell, assign or transfer the App or your account to any third party;
- bypass, disable or circumvent any security features, digital rights management or access controls;
- use the App to transmit malware, viruses, worms or malicious code;
- use automated systems or software to extract data from the App ("scraping");
- use the App in any manner that interferes with, disrupts or overburdens our infrastructure or third-party services.
5. Your account and security
You are responsible for keeping your login credentials confidential and secure. You must not share your username, password or PIN with anyone else.
If biometric authentication (such as Touch ID or Face ID) is enabled on your device, you must ensure that only your biometric data is registered on the device if it is used to access the App.
You must notify your Organisation and us immediately at TEAM@PLATONE.CO.UK if you suspect any unauthorised access to or use of your account or device.
6. Location tracking
The App contains location-tracking capabilities designed to capture location data while performing field work, as configured by your Organisation. You acknowledge that your Organisation determines when location tracking is active for your role and who has access to the resulting data.
7. Offline working and data sync
The App supports offline data storage to allow work to continue when network coverage is unavailable. Data entered offline is stored locally in encrypted form and synchronized automatically when network connectivity is restored.
You are responsible for ensuring that your device connects to the internet regularly to allow pending work records to upload.
8. Intellectual property
All intellectual property rights in the App, including software, code, designs, graphics, trade marks and documentation, belong to us or our licensors. All rights not expressly granted to you are reserved.
The App includes third party components licensed to us, including mapping data from OpenStreetMap, which is made available under the Open Database Licence and is copyright OpenStreetMap contributors. 9. Privacy and data protection
Our Privacy Policy at https://www.platone.co.uk/privacy-policy/ explains what personal data the App processes, why, who it is shared with and what rights you have. It forms part of these terms. Your Organisation is the data controller for the working data processed through the App.
10. Device and network requirements
You are responsible for obtaining and maintaining a compatible mobile device and internet connection required to use the App. We are not responsible for data charges, roaming fees or connectivity issues incurred while using the App.
11. Availability and updates
We do not guarantee that the App will be available continuously, error-free or uninterrupted. We may issue updates, bug fixes or improvements to the App from time to time. Some updates may be mandatory to continue using the App.
12. Disclaimers and limitation of liability
To the maximum extent permitted by applicable law:
- the App is provided "as is" and "as available" without warranties of any kind, express or implied;
- we do not warrant that the App will meet your requirements or achieve specific results;
- our total liability to you in connection with the App, however arising, is limited to £1.
Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
13. Suspension and termination
We or your Organisation may suspend or terminate your access to the App at any time without notice if you breach these Terms, or if your Organisation's account is suspended or terminated.
14. General
Changes to these terms. We may update these terms as the App changes. The current version is always available at https://www.platone.co.uk/terms-conditions/ and in the App. Where a change is material we will tell your Organisation in advance, and continuing to use the App after the change takes effect means you accept the updated terms.
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
Governing law. These terms and any dispute arising from them are governed by the law of Northern Ireland, and the courts of Northern Ireland have exclusive jurisdiction.
